Legal Requirements for Eviction in Kenya

In Kenya, a landlord cannot forcibly evict a tenant without following the correct legal process. Self-help eviction — changing locks, removing doors, cutting utilities — is illegal and exposes landlords to criminal liability. The correct process begins with a formal written notice.

  • Non-payment of rent — serve a formal demand notice, then proceed to court
  • Breach of lease terms — written notice to remedy within a specified period
  • End of fixed term — notice must be given before the term expires
  • Residential tenancies under the Rent Restriction Act require Rent Tribunal approval
  • Business premises disputes go to the Business Premises Tribunal
  • Court order required before physical eviction in all cases

Notice Periods in Kenya

The required notice period depends on the type of tenancy and the ground for eviction.

  • Month-to-month tenancy — one month's notice minimum
  • Fixed-term lease — notice as specified in the agreement, or one rental period
  • Non-payment of rent — immediate demand, court proceedings if unpaid after 7–14 days
  • Serious breach — reasonable period to remedy, typically 7–14 days
  • Owner's personal occupation — six months notice for most business premises
