Rules for Rent Increases in Kenya
Kenyan landlords cannot arbitrarily increase rent at any time. The rules depend on whether the tenancy is residential or commercial, and whether the property falls under the Rent Restriction Act.
- Standard residential leases — rent can only be increased at renewal or as provided in the lease
- Rent Restriction Act properties (low-cost residential) — controlled increases, tribunal oversight
- Business premises under Cap 301 — controlled increases, disputes to Business Premises Tribunal
- Market-rate properties — increase as agreed in lease, with proper notice
- Minimum notice for rent increase — one full rental period (typically one month)
What the Notice Must Include
A valid rent increase notice should contain all the following information to be enforceable.
- Landlord's full name and contact details
- Tenant's full name
- Property address
- Current monthly rent in KES
- New monthly rent in KES and percentage increase
- Effective date of the increase — at least one full rental period from service
- Date the notice is served
- Landlord's signature
Serving the Notice
Deliver the notice in person and ask the tenant to sign a copy as acknowledgement, or send by registered post. Keep a copy of the served notice and proof of delivery. If a tenant disputes the increase, they may refer the matter to the Rent Restriction Tribunal (residential) or Business Premises Tribunal (commercial). A reasonable, well-documented increase is much less likely to be challenged.
